Terms & Conditions

The buyer enters into a legally binding purchase agreement with Benke GmbH, Espenstrasse 135, CH-9443 Widnau, Tel. +41(0)71 372 00 20, or info@benke.ch, by accepting the following terms and conditions.

The buyer compiles a shopping cart from the Benke range and sends it to the seller by confirming the shopping cart via email. The seller confirms the shopping cart via email, thereby making the purchase legally valid.

All prices stated in the offer are inclusive of the legally applicable VAT. These are fixed offer prices and apply for the duration of the offer’s validity period. The prices become legally binding upon confirmation by the seller via email.

Delivery of the ordered goods is subject to availability and the possibility of reordering from our suppliers. Upon placing an order, the buyer receives an individual confirmation by email. The customer’s order is only deemed accepted once the shopping cart has been confirmed. Delivery is made on account. The buyer also has the option to pay by credit card, PayPal or in advance. Self-collection (free of charge) from our warehouse is also possible – our opening hours are Mon–Fri 07:30 – 12:00 and 13:00 – 17:00. If the complete ordered goods are not available, we will produce or order them on request in consultation with the buyer. Payment is due within 14 days without deduction of discount. The complete and correct specification of the delivery address is the responsibility of the purchaser (including address changes). If the purchaser provides an incorrect delivery address, delivery may not be possible under certain circumstances. The costs incurred will be charged to the purchaser.

For Switzerland: A-Post CHF 9.- / Express delivery CHF 22.50 (per parcel up to 30 kg). Guaranteed delivery the next day by 9:00 a.m. including Saturday delivery (surcharges for express deliveries are borne by the customer.)
Free shipping from a net order value of CHF 300.00. The information provided is indicative. It may be changed at any time without prior notice.

Service fees are charged for payments with PayPal and credit card (MasterCard, Visa, American Express etc.). These amount to 2.4% of the ordered goods value (postage excluded). The percentage may vary and may be changed at any time without prior notice. Service fees are always borne by the customer.

Goods to European countries abroad are shipped on request and shipping costs are calculated according to effort. EU guidelines apply.
The costs for customs clearance and all fees incurred for processing the delivery of goods are to be borne by the buyer (customer).

Benke GmbH charges an expense fee of CHF 10.- for the 2nd reminder & an expense fee of CHF 30.- for the 3rd reminder. If the reminders remain unsuccessful, the claim will be handed over to a debt collection company. In this case, an effective annual interest rate of up to 15% may additionally be charged on the outstanding invoice amount from the due date. The commissioned debt collection company will assert the outstanding amounts in its own name and on its own account and may charge additional processing fees.
Information on payment processing may be forwarded to the Swiss association Creditreform.

The buyer may withdraw from the ordered products without stating reasons within eight days of receipt and return the original packaged and unused goods to the delivery address stated in writing. After expiry of the withdrawal period, the purchase contract is legally binding.

The buyer may return goods purchased from us within 8 days of receipt. The prerequisite is that the goods are in their original packaging, undamaged and resalable. This applies in particular to cleaning and care products, which can only be taken back with an intact seal. A reason for returning the goods is not required. The purchase price will be refunded to the buyer to an account specified by them. Only the value of the goods will be refunded. If the buyer is responsible for deterioration, damage or other loss of value, they must compensate the value. If the returned goods are therefore damaged or no longer resalable, we reserve the right to claim for reduction in value and/or damages.

In the event of justified complaints, the buyer is entitled, within the scope of the warranty claim, to rectification, replacement or a credit note. In cases of warranty, please contact us in writing or by phone at:

Delivered goods remain our property until paid in full and must be treated accordingly. Ownership shall only pass to the buyer after expiry of the withdrawal period or the return period, provided that the goods have been paid for in full.

If the buyer refuses acceptance of the ordered goods without having cancelled the order before it left our company, we will charge a processing fee of 10% of the value of the goods, but at least CHF 20.00. If the buyer is in default of payment for the goods, we charge fees for each reminder. We reserve the right to claim further damages and to take legal action. If the buyer withdraws in part or in full from an offer, we are entitled to charge 5% of the value of the goods, but at least CHF 20.00 as compensation for expenses.

The customer consents to the necessary processing of the data provided to us. We store these data only for the purpose of information, delivery and invoicing. We assure you that we do not pass on your data to third parties.
Exception: Information about payment processing may be forwarded to the Swiss association Creditreform.

Should any of the provisions set out herein be invalid, it shall be replaced by an effective provision and/or supplemented accordingly. The validity of the remaining provisions shall remain unaffected.

Only Swiss law shall apply to deliveries by Benke GmbH. Both parties recognise the exclusive jurisdiction of the ordinary court in – CH-9450 Altstätten SG for all disputes arising out of or in connection with deliveries by Benke GmbH.
