Sales and Delivery Terms

1. General

The buyer enters into a legally binding purchase agreement with Benke GmbH, Espenstrasse 135, CH-9443 Widnau, Tel. +41 (0)71 372 00 20, or info@benke.ch, by accepting the following Terms and Conditions.

2. Placing an Order

The buyer selects products from the Benke range and compiles a shopping basket, which is then sent to the seller by confirming the order via email. The seller confirms the order by email, making the purchase legally binding.

3. Prices

All prices stated in the offer include the applicable statutory value-added tax (VAT). The quoted prices are fixed for the validity period of the offer. Prices become legally binding once confirmed by the seller via email.

4. Delivery Conditions

Delivery of the ordered goods is subject to availability and restocking possibilities from our suppliers. The buyer receives an individual confirmation by email upon placing the order. The order is considered accepted only after confirmation of the shopping basket. Delivery is made on account. The buyer also has the option to pay by credit card, PayPal or prepayment. Self-collection (free of charge) is possible at our warehouse during our opening hours: Monday to Friday, 07:30–12:00 and 13:00–17:00. If the complete order is not available, we will produce or reorder the goods after consultation with the buyer. Payment is due within 14 days without any discount. The buyer is responsible for providing accurate and complete delivery information (including address changes). If incorrect delivery details are provided, delivery may not be possible. Any resulting costs will be charged to the buyer.

5. Shipping and Service Fees

For Switzerland: A-Post CHF 9.00 / Express delivery CHF 22.50 (per parcel up to 30 kg). Guaranteed next-day delivery by 9:00 a.m., including Saturday delivery. Surcharges for express deliveries are borne by the customer. Free shipping from a net order value of CHF 300.00. These are guide prices and may be changed at any time without prior notice.

Service fees apply for payments made via PayPal and credit card (MasterCard, Visa, American Express, etc.). These amount to 2.4% of the total order value (excluding postage). The percentage may vary and can be changed at any time without notice. Service fees are always borne by the customer.

6. International Shipping

Goods can be shipped to European countries upon request. Shipping costs are calculated based on actual expenditure and in accordance with EU regulations. All customs clearance costs and any additional charges associated with delivery are borne by the buyer.

7. Reminders and Debt Collection

Benke GmbH charges an administrative fee of CHF 10.00 for the second reminder and CHF 30.00 for the third reminder. If the reminders remain unsuccessful, the case will be handed over to a debt collection agency. In such cases, an effective annual interest rate of up to 15% on the outstanding invoice amount from the due date may be charged. The appointed collection agency will pursue the outstanding amounts in its own name and on its own account and may apply additional handling fees. Information regarding payment transactions may be forwarded to the Swiss Creditreform Association.

8. Right of Withdrawal

The buyer may withdraw from the purchase without giving any reason within eight days of receipt of the goods, provided the goods are unused and returned in their original packaging to the address stated in writing. After the withdrawal period has expired, the purchase contract becomes legally binding.

9. Returns

The buyer may return goods purchased from us within eight days of receipt, provided they are in their original packaging, undamaged and resalable. This applies in particular to cleaning and care products, which can only be returned with an intact seal. No justification for the return is required. The purchase price will be refunded to an account specified by the buyer, but only the value of the goods will be reimbursed. If the buyer is responsible for any deterioration, damage or reduction in value, they must compensate accordingly. If the returned goods are damaged or no longer resalable, we reserve the right to claim a reduction in value or compensation.

10. Warranty

In the event of justified complaints, the buyer is entitled to rectification, replacement or credit within the scope of the warranty. For warranty claims, please contact us in writing or by phone at:

11. Retention of Title

Delivered goods remain the property of Benke GmbH until full payment has been received and must be treated accordingly. Ownership is transferred to the buyer only after the expiry of the withdrawal or return period, provided that the goods have been paid for in full.

12. Refusal of Acceptance / Withdrawal / Default of Payment

If the buyer refuses to accept the ordered goods without cancelling the order before dispatch, we will charge a handling fee of 10% of the value of the goods, but not less than CHF 20.00. If the buyer delays payment, reminder fees will be charged for each reminder. We reserve the right to claim further damages and to take legal action. If the buyer withdraws partially or completely from an accepted offer, we are entitled to charge 5% of the value of the goods, but at least CHF 20.00, as a handling fee.

13. Data Protection

The customer agrees to the necessary processing of the data provided to us. These data are stored solely for communication, delivery and invoicing purposes. We guarantee that your data will not be passed on to third parties. Exception: Information regarding payment processing may be forwarded to the Swiss Creditreform Association.

14. Final Provisions

If any of the provisions contained herein are found to be invalid, they shall be replaced or supplemented by a valid provision that most closely reflects the intended purpose. The validity of the remaining provisions shall not be affected.

15. Applicable Law and Place of Jurisdiction

Swiss law exclusively applies to all deliveries by Benke GmbH. Both parties agree that the ordinary court in CH-9450 Altstätten SG shall have exclusive jurisdiction for all disputes arising from or in connection with deliveries by Benke GmbH.
